Terms and Conditions for online order request and payment

Volvo Car Australia Pty Ltd (ACN 004 830 611), of 65 Epping Road, North Ryde NSW 2113 (“Volvo Cars”) offers customers the ability to view selected Volvo vehicles through the Volvo Cars Website www.volvocars.com/au (“Website”), configure selected vehicles and to submit an expression of interest to register your interest in ordering a Volvo vehicle from your nominated authorised Volvo Cars retailer (“Authorised Retailer”) (“Service”).

To use the Service you must be aged over 18 years and a resident of Australia.

By submitting an expression of interest to purchase a Volvo vehicle from an Authorised Retailer via the Service (“Order Request”) you agree to be bound by these terms and conditions.

KEY TERMS

From time to time, Volvo Cars may experience extended delivery times, supply chain challenges and disruptions for new vehicles in Australia. While we will do all we can to manage this, unfortunately these issues are often outside Volvo Cars’ control.
The impact of this is that the price of vehicles featured on the Service are indicative only and may change from time to time. The final retail price of your Selected Vehicle may be subject to change and will be agreed between you and the Authorised Retailer.
Features and specifications may also change between time of Order Request, order placement and final delivery due to supply chain impacts and shortages of components (such as semi-conductors). Volvo Cars reserves the right to make such changes to its vehicle specifications from time to time.
Wait times vary across our model range and demand may exceed available supply.

Order Request Process
The Service permits you to start your journey to vehicle ownership including:
i. configure your preferred Volvo vehicle (“Selected Vehicle”) from a range of selected Volvo vehicles
ii. check the estimated Selected Vehicle price
iii. choose your payment method, including available finance
iv. provide your contact details
v. nominate your preferred Authorised Retailer to arrange purchase and test drive options regarding the Selected Vehicle
vi. pay a deposit which will go towards the overall purchase price of your Selected Vehicle if you ultimately place an order for the Selected Vehicle (“Order Deposit”). The Order Deposit is made via a Payment Processor and received by your selected Authorised Retailer.

You acknowledge and agree that the Service does not permit you to place an order or guarantee the availability of your Selected Vehicle. To place an order and confirm wait times you will need to contact an Authorised Retailer. Only selected Volvo Cars models are available via the Service.

The price shown is Volvo Cars’ Recommended Driveaway Price. The final price for your Selected Vehicle will be agreed between you and the Authorised Retailer. Your Selected Vehicle may come with additional packages such as digital services, roadside assistance and/or a service plan. The Volvo Cars’ Recommended Driveaway Price also shows a delivery fee which is a service fee to be paid by you to the Authorised Retailer for the registration and delivery of your Selected Vehicle.
The Selected Vehicle shown in the confirmation order request submitted to the Authorised Retailer may differ from the vehicle that you test drive and end up purchasing.

The Order Deposit
To start your journey to Volvo ownership, you can pay an Order Deposit of AUD$1,000 which will be applied towards the purchase of your Selected Vehicle by the Authorised Retailer. If you do not proceed to place an order or your order is cancelled in accordance with these terms, this amount will be refunded by the Authorised Retailer.

Third Party Payment Processors
Payments made via the Website are processed by third party payment processors (“Payment Processors”) and are subject to the terms of use and privacy policies of those parties. They are not accessible or controlled by Volvo Cars and we make no representations or warranties, whether express, implied, statutory or otherwise, with respect to any Payment Processors or the services that they provide.
You should review their terms and conditions and any privacy policy carefully. If there is a conflict between the terms and conditions of this Agreement and the terms and conditions applicable for a specific payment service, including of a contract with a Payment Processor, the latter terms and conditions will take precedence with respect to your use of or access to that payment service, unless otherwise specified in such terms and conditions. For payments processed via Payment Processors, we may receive information related to your payment, such as card type and last four digits, postal code, country of origin.

Volvo Cars is not responsible for acts or omissions of the Payment Processors. You agree to pay the Authorised Retailer, through the Payment Processor(s), the Order Deposit and all applicable fees charged by the Payment Processor(s). You agree and authorise the Authorised Retailer and applicable Payment Processor(s) to charge all such sums (including all applicable taxes) to the payment method(s) specified in the Order Request Summary ("Payment Method").
By entering into this Agreement and using the Services, Customer agrees for the Order Deposit Fee to be deducted from their nominated Payment Method.

Cancellation
You can cancel your Order Request at any time before entering into a binding contract of sale by contacting the Authorised Retailer. In the event you cancel your Order Request your Order Deposit will be fully refunded by the Authorised Retailer.
The Authorised Retailer reserves its rights to cancel your Order Request. In the event of such cancellation due to the Authorised Retailer’s needs or requirements, the Authorised Retailer will refund the Order Deposit to the credit card or payment method used to pay the Order Deposit.
Once you execute a contract of sale for a vehicle, any cancellation will be governed by the terms of that contract, including applicable refunds.

Purchase from Third Party Authorised Retailers
Placing an Order Request and paying the Order Deposit does not guarantee you a vehicle, nor does it obligate you to purchase a vehicle.
Volvo Cars will share the information of the Selected Vehicle, information collected from your use of the Service and your contact details with the Authorised Retailer. Once your Order Request and Order Deposit are received, an Authorised Retailer will contact you to discuss your Selected Vehicle or an alternative vehicle in the event your preferred vehicle is not available.
To buy the Selected Vehicle, or an alternative vehicle, you will need to:
1. Contact or visit an Authorised Volvo Cars showroom.
2. Execute the necessary documents for vehicle purchase.
3. If relevant, finalise your finance documents with your selected financial provider.
4. Arrange payment for the Selected Vehicle to the Authorised Retailer (or relevant leasing or financial services provider).

Delivery
Delivery times vary based on the complexity of, and demand for, the Selected Vehicle. The Authorised Retailer will be able to provide you with more up to date advice and discuss delivery options with you. Volvo Cars may be experiencing longer than usual wait times for selected models. Placing an Order Request does not guarantee you a place in the queue. To secure your Selected Vehicle you will need to place an order with an Authorised Retailer and enter a contract of sale.

Privacy

Volvo Cars collects the personal information you provide on the Website for the purposes of providing the Service, and if applicable, facilitating your Order Request.
If you do not provide all the information that Volvo Cars requests, Volvo Cars may not be able to provide you access to the Service, or you may not be able to use all the features of the Website. General Terms
By using the Service you represent and warrant that all information you provide is true and accurate. If at any time it is discovered that any of the information you have provided is not true or not accurate, the Authorised Retailer may cancel your Order Request.
Any costs associated with accessing our Website are your responsibility and may depend on the internet service provider used.
There are certain guarantees, warranties and rights imposed by law in relation to our Service which cannot be excluded, restricted or modified or may only be limited to a certain extent (“Statutory Obligations”). Nothing in these Terms and Conditions excludes, restricts or modifies the Statutory Obligations. Except to the extent set forth in these Terms and Conditions, and to the maximum extent permitted by law, Volvo Cars otherwise excludes all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which you may suffer or incur in connection with the Service, including but not limited to any technical difficulties or access issues with the website (whether or not under our control) except where that loss has been caused by Volvo Cars’ gross negligence. Volvo Cars reserve the right to cancel the Service or change the offer, including the availability of models and the vehicle specifications, for any reason and at any time.
These terms may be updated from time to time. If you do not agree to any update to the Terms, you must stop using the Service.
These Terms and Conditions are governed by the laws of New South Wales and the parties submit to the exclusive jurisdiction of those courts.
