Volvo Car Turkey Automobile Limited Company Information Notice Regarding Processing of Customer Personal Data

Dear Customers; Volvo Car Turkey Automobile Limited Company ("Volvo" or "Company") would like to inform you about our practices and your rights under the Law on Protection of Personal Data numbered 6698 ("KVKK").

Within the framework of Article 10 titled "Obligation to Inform the Data Controller" and Article 11 titled "Rights of the Data Subject" regulated in the KVKK; we hereby provide this Information Notice ("Notice") to inform and enlighten you about the purposes for which your personal data will be processed, to whom and for what purposes your processed personal data may be transferred, the method of collecting your personal data, and your other rights specified in Article 11 of the KVKK.

Protecting the privacy and security of your personal data is important to Volvo. In this regard, we take necessary technical and administrative security measures to protect your personal data against unauthorized access or loss, misuse, disclosure, alteration, or destruction, in accordance with information security standards and procedures. These security measures are provided at an appropriate level in accordance with possible risks, taking into account technological possibilities. Despite Volvo's implementation of necessary information security measures, in case personal data is damaged or falls into the hands of third parties as a result of attacks on the website and system, Volvo will immediately notify you and the Personal Data Protection Board.

1. Identity of the Data Controller

The Data Controller is Volvo Car Turkey Automobile Limited Company, registered with the Istanbul Trade Registry with registration number 422515, MERSIS number 0925011785500014, located at Fatih Sultan Mehmet Mahallesi Poligon Caddesi Buyaka 2 Sit. 2. 2. Purposes of Processing Personal Data

Your personal data is processed in compliance with the personal data processing conditions specified in Article 5 of the KVKK, based on one or more of these conditions or with your explicit consent, in accordance with the personal data processing principles specified in Article 4 of the KVKK, and in compliance with the obligations required by the relevant legislation. Your personal data is processed for the following purposes:

  • Performing necessary activities by our company's departments and/or partners to benefit our customers from the products and services offered by our company, • Creating and managing customer records,
  • Conducting assessment, analysis, and risk management activities related to customers within legal boundaries,
  • Customizing the products and services offered by our company according to customer preferences, usage habits, and needs, and recommending them to customers,
  • Informing about changes that may occur in our service terms and electronic services,
  • Ensuring the legal and commercial security of our company and individuals in business relationships,
  • Planning and conducting business with our business partners, authorized dealers, authorized service providers, and suppliers,
  • Organizing and monitoring technical techniques such as test drives of vehicles,
  • Determining and implementing the commercial and business strategies of our company,
  • Conducting market research and analysis, including customer satisfaction surveys,
  • Resolving customer complaints and processing data access or correction requests,
  • Participating in contests, prize draws, similar promotions, and loyalty programs, and managing these activities,
  • Gathering information about customer-specific developments, creating and updating performance reports,
  • Monitoring and managing the credit evaluation processes to be conducted by credit providers with whom we have agreements for our products and/or services,
  • Facilitating the social media sharing function,
  • Planning and conducting customer-specific sales and marketing activities,
  • Monitoring and executing legal processes and communication processes with official authorities,
  • Planning information security processes, establishing and managing information technology infrastructure,
  • Continuation of business and operations, execution of company activities and procedures,
  • Management of customer relations and monitoring of corporate governance activities,
  • Fulfillment of warranty obligations, monitoring of insurance and coverage processes,
  • Conducting financial, accounting, and financial transactions, including post-sale billing, and performing risk management,
  • Fulfillment of post-sale support obligations, determination of damage or accident processes, assessment of value, and management and monitoring of other related processes,
  • Sales and marketing of spare parts for Volvo passenger and commercial vehicles,
  • Contacting potential customers at events such as fairs, roadshows, exhibitions, sponsorships, and similar potential customer events organized to increase brand awareness, planning active visits and event organization, determining potential consumers in this way, and informing consumers about campaigns,
  • Obtaining necessary information and approvals from regulatory and supervisory authorities and official authorities in accordance with their requests and inspections, as well as from authorities who will review relevant applications,
  • Determining legal rights and defending them; protection and use of our or our business partners' activities, rights, privacy, security, or property, or limiting our damage,
  • Designing contractual processes with you as our customers, such as sales, pre-sales support, leasing, performing all necessary transactions, and tracking them, initiating the vehicle rental process, evaluating it, concluding it, conducting risk assessment, conducting contract processes, and, in short, planning and executing operational processes related to leasing,
  • Conducting risk management, ensuring business continuity, tracking contract processes or legal claims,
  • Conducting market research, planning and organizing activities to ensure and/or increase loyalty to products and services, among other purposes, within the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK (Law on Protection of Personal Data).

3. To Whom and for What Purposes Personal Data Can Be Transferred

Your personal data may be shared, subject to the security and confidentiality principles specified in the legislation, with our business partners, suppliers, shareholders, authorized dealers, logistics companies, event companies, digital agencies, call center service providers, audit firms, banks, financial institutions, insurance companies, legal and tax consultancy firms, and other business partners, both domestically and abroad, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK, and may be transferred abroad based on your explicit consent.

4. Method of Collecting Personal Data and Legal Ground

Your personal data is collected by Volvo through various methods, including directly from you, through information and documents provided by you, through phone or email correspondence, during visits to our premises, during promotional and sponsorship events, through other business partners, authorized dealers, and service providers, from institutions such as the General Directorate of Security and the Risk Center, and from third parties, within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK and in accordance with the principles and procedures specified by the relevant legislation, both automatically and non-automatically, in written, oral, or electronic form, through Cookies and similar technologies. Your personal data is processed for the purposes specified in this Information Notice and to fulfill our legal obligations.

5. Your Rights under the KVKK

Under Article 11 of the KVKK, you may apply to Volvo to:

  • Learn whether your personal data is processed or not,
  • Request information if your personal data is processed,
  • Learn the purpose of the data processing and whether data is used for its purpose,
  • Know the third parties to whom your personal data is transferred,
  • Request correction of your personal data if it is incomplete or inaccurate, and request that the transaction made in this context be notified to third parties to whom your personal data has been transferred,
  • Request deletion or destruction of your personal data in case the reasons requiring its processing disappear despite being processed in accordance with the Law and other relevant laws, and request that the transaction made in this context be notified to third parties to whom your personal data has been transferred,
  • Object to the emergence of a result against you by analyzing your personal data exclusively through automated systems,
  • Request the compensation of the damage in case you suffer damage due to the unlawful processing of your personal data.

You can send your requests regarding the use of your rights under the KVKK to kvkktr@volvocars.com by indicating "Personal Data Protection Law Information Request" in the subject section of the e-mail or submit it in person with a wet-signed petition to the address "Fatih Sultan Mehmet Mahallesi Poligon Caddesi Buyaka 2 Sit. 2. Kule No:8 B/14 K:4 34771 Tepeüstü Ümraniye-İstanbul" along with identity documents or send it through a notary public. You can access the application form for your request on our website at www.volvocars.com.tr. Volvo will conclude your requests related to your rights, depending on the nature of the request, as soon as possible and at the latest within 30 (thirty) days, free of charge. If additional costs arise due to the execution of your requests by Volvo, the fees specified in the tariff determined by the Personal Data Protection Board may be requested by Volvo. We would like to emphasize that if your personal data is processed based on explicit consent and you withdraw your explicit consent, you will be excluded from the membership/loyalty program for which the processing based on that explicit consent is necessary, and you will not benefit from the advantages of the said operations as of the relevant date. You can always follow the changes regarding personal data in the legislation and our practices on the relevant page of our website.

Data subjects acknowledge and declare that they know that it is important for them, in terms of the Law on Protection of Personal Data No. 6698, that the information they provide is accurate and up-to-date, and that the responsibility for the consequences of providing incorrect information belongs entirely to them.

Personal data processed for the purposes stated in this Information Notice will continue to be used by us after anonymization when the purpose requiring the processing of personal data in accordance with the KVKK and other relevant laws disappears and when the periods determined by the laws expire.

Volvo may make changes to this Information Notice at any time. These changes will take effect immediately upon the publication of the amended Information Notice on www.volvocars.com.tr.
