VOLVO CAR MALAYSIA “Volvo Birthday Sale” (“CAMPAIGN”)

Campaign Terms and Conditions (“Campaign T&C”)

1. General

This Campaign is promoted by Volvo Car Malaysia Sdn Bhd (Registration No. 199901007530 (482430-K)) with business address at Lot 01-13A, 13A Floor, Menara Symphony, No, 5, Jalan Professor Khoo Kay Kim, Seksyen 13, 46200 Petaling Jaya, Selangor (“Volvo Car Malaysia”).

    2. Term

    The Campaign will start on 26 April 2024 and will end on 31 May 2024, 11.59pm (“Term”), subject to Clause 3.1.

      3. How to participate

      The participant shall be eligible to take part in the Campaign, subject to Clause 3.2:

      1. Book their selected Volvo vehicle (“Vehicle”) through the online store at https://shop.digitalvolvo.com/my/shop-online (“Online Store”) at www.volvocars.com/my (“Website”) from 26 April 2024 to 28 April 2024 only;

      2. Accept and sign the Vehicle Sales Order (“VSO”) and the VSO Terms and Conditions; and

      3. Ensure that all terms and conditions for the purchase of the Vehicle shall be fulfilled and adhered to by latest 31 May 2024 at 11.59pm (including the delivery of the Vehicle to the Eligible Participant to be completed no later than 31 May 2024 at 11.59pm). For the avoidance of doubt, “Delivery” shall mean when the Vehicle and the keys has been handed over to the participant as decided by Volvo Car Malaysia.

        (Participants fulfilling all the above criteria shall be defined as “Eligible Participant”)

      Participant shall not be considered an Eligible Participant if he/she is:

      1. An employee of Volvo Car Malaysia, its affiliated companies, the agencies connected with the Campaign or Volvo Car Malaysia authorised dealers and its affiliated companies; and/or

      2. a household or an immediate family member to the persons stated in Clause 3.2.1. (defined as parents, siblings, children and spouse, regardless of where they live) or such other family member as unless permitted by Volvo Car Malaysia in writing.

      Volvo Car Malaysia reserves the right to verify that eligibility requirements are met and may require such further information or documents as it considers reasonably necessary for this purpose.

      The participant shall solely be responsible for ensuring that all terms and conditions for the purchase of the Vehicle shall be fulfilled and adhered to by latest 31 May 2024 at 11.59pm (including the delivery of the Vehicle to the Eligible Participant to be completed no later than 31 May 2024 at 11.59pm) to be eligible to participate in this Campaign.

      4. How to win the Volvo Exclusive Giftbox Worth RM500 (“Giftbox”)

      The first ninety seven (97) winning Eligible Participants that fulfil the requirements in Clause 4.1.1 to Clause 4.1.3 shall be entitled to a Giftbox.

      Each of the Giftbox shall contain the following items:

      1. A water bottle worth RM110;

      2. A Volvo cap worth RM138; and

      3. A Volvo Magsafe Cardholder worth RM384.

      Volvo Car Malaysia reserves the right to vary the items contained in the Giftbox with items of equivalent value if the listed items in 4.2.2 are not available.

      The Giftbox shall be provided to the winning Eligible Participant during Delivery.

      5. How to win a trip to Sweden worth RM50,000 (“Trip”)

      The Eligible Participant shall be required to do the following:

      1. Fulfil the requirements in Clause 3.1;

      2. Post a picture or video on Instagram/Facebook with birthday wishes to Volvo and include the contest hashtag [#FlyMetoSweden] and a creative explanation to why Volvo Car Malaysia should fly the Eligible Participant in the caption anytime from 26 April 2024 to 31 May 2024 (“Post”) (24 hour Stories are not eligible); and

      3. Ensure that the service provider supporting the Eligible Participant in the purchase of the Vehicle (“Service Provider”) submits the Post to Volvo Car Malaysia via email with the Vehicle Identification Number of the delivered vehicle.

      Only one Post shall be submitted to Volvo Car Malaysia for each Vehicle Identification Number.

      The Post must be original and must not include third-party owned material, be sexually explicit or offensive or contain commercial content or violate any laws or regulations.

      By participating in the Campaign and submitting the Post, Eligible Participant agrees to:

      1. grant Volvo Car Malaysia a non-exclusive, worldwide, royalty-free, irrevocable, and sub-licensable right to publish, communicate, and reproduce the Post and any content created in relation to this Campaign in Volvo Car Malaysia’s social media channels (including but not limited to LinkedIn, Facebook and Instagram) during the Term and for the following twenty four (24) months from the Term without notice or compensation; and
      2. waive in favour of Volvo Car Malaysia and its sub-licensees all moral rights in the Comment and any content created in relation to this Campaign.

      Volvo Car Malaysia will reach out to the winner of the Trip (“Winner”) on 21 June 2024 via Volvo Car Malaysia’s official social media (Facebook and Instagram). The Winner will have seven (7) days to provide Volvo Car Malaysia with the required contact information. Otherwise, Volvo Car Malaysia reserves the right to forfeit the Trip and award it to an alternate Winner.

      In the event that the Winner does not fulfil the eligibility criteria in accordance with Clause 3.1 and Clause 6 of the Campaign T&C, Volvo Car Malaysia reserves the right to forfeit the Trip, if already granted to that Winner, and award it to an alternate Winner as decided by Volvo Car Malaysia.

      Volvo Car Malaysia reserves the right to decide what the specifications of the Trip including but not limited to the duration, travel itinerary, accommodations, and all other specifications in relation to the Trip.

      Volvo Car Malaysia shall have absolute discretion as to which Post wins the Trip based on the creativity of the Post.

      By participating in this Campaign, all contents in relation to the Campaign produced and submitted by the participants to Volvo Car Malaysia shall be the property of Volvo Car Malaysia.

      6. Data Protection

      Volvo Car Malaysia will only use participants’ information to administer the Campaign. Volvo Car Malaysia will observe and comply with the provisions of the Personal Data Protection Act 2010 and/or any regulations, rules, standards, or directions (including all the amendments made to the same from time to time) passed thereunder when it is processing the participants’ personal data.

        7. Limitations of Liability

        Except for any liability that cannot by law be excluded, Volvo Car Malaysia (including its respective officers, employees, and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Campaign.

        Except for any liability that cannot by law be excluded, Volvo Car Malaysia (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of: (a) All contents in relation to the Campaign (including all Posts) (b) any technical difficulties or equipment malfunction (whether or not under the Volvo Car Malaysia’s control) (c) any theft, unauthorised access or third party interference (d) any variation in Trip value to that stated in these Campaign T&C or (e) any tax liability incurred by a Selected Eligible Participant.

          8. Miscellaneous

          The Giftbox and/or the Trip is not transferable and cannot be exchanged for cash.

          The Eligible Participant warrants all information provided by the Eligible Participant (including Selected Eligible Participant) to Volvo Car Malaysia in relation to this Campaign is true and accurate.

          Volvo Car Malaysia reserves the right to disqualify any participant from this Campaign if it has reason to believe that the Campaign T&C is not being observed.

          Volvo Car Malaysia reserves the right to vary the Campaign T&C from time to time and/or to issue clarifications on the Campaign T&C should this be required, and such variations and clarifications shall be binding.

          If any provision of the Campaign T&C is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

          The Campaign T&C, and all issues arising out of it shall be governed in accordance with the laws of Malaysia and are subject to the exclusive jurisdiction of the courts of the said territory.

          By participating in this Campaign, all participants acknowledge and agree to be bound by the Campaign T&C.
