VOLVO CAR MALAYSIA “EMBRACE NEW BEGINNINGS” (“CAMPAIGN”)
Campaign Terms and Conditions (“Campaign Terms”)
1. General
The Campaign is promoted by Volvo Car Malaysia Sdn Bhd., with Registration No. 199901007530 (482430-K) with Business Address at Lot 01-13A, 13A Floor, Menara Symphony, No, 5, Jalan Professor Khoo Kay Kim, Seksyen 13, 46200 Petaling Jaya, Selangor (“Volvo Car Malaysia”) and supported by Volvo Car Malaysia Sdn Bhd authorised dealers.
2. Term
The Campaign will last for three (3) weeks starting Monday 22nd January 2024 and will end on Monday 19th February 2024 (“Term”).
3. How to participate
Follow Volvo Car Malaysia’s Instagram account (@volvocarmalaysia) and authorised dealer’s Instagram account.
Publish a post in Instagram in the form of photo/video featuring any passenger, recreational or other vehicle marketed under the trademark “Volvo” (“Post”).
Tag or mention Volvo Car Malaysia’s official page [@volvocarmalaysia], and authorised dealer’s official page and include the contest hashtag [#EmbraceNewBeginnings] in the Post.
Set Instagram account privacy as “Public” so the Post can be reviewed by Volvo Car Malaysia’s authorised dealers.
The Post must be original and taken by the participant over which the participant has all necessary rights, title and interest, including copyright. The Post must not include third-party owned material, be explicit or offensive, contain commercial content or violate any laws or regulations.
By participating in the Campaign and submitting the Post, participant agrees to (a) grant Volvo Car Malaysia and authorised dealer a non-exclusive, worldwide, royalty-free, irrevocable and sub-licensable right to publish, communicate, and reproduce the Post in Volvo Car Malaysia and authorised dealer’s social media channels (including but not limited to LinkedIn, Facebook and Instagram) during the Term and for the following 24 months without notice or compensation (b) waive in favour of Volvo Car Malaysia and authorised dealers and its sub-licensees all moral rights in the Post.
4. Selection of the Winner
Volvo Car Malaysia’s authorised dealer will review the Posts and select the winners of the Campaign (“Winner”). Selection of the Winner will consider elements such as the creativity, relevance to the purpose of this Campaign, and overall visual appeal of the Post.
Volvo Car Malaysia’s authorised dealer will choose a total of 5 Winners for the contest.
5. Communication of the Winner
Winners will be contacted via Instagram direct message or to be informed physically in the showroom. Winners will have to provide his/her contact information (full name, phone and mailing address) so Volvo Car Malaysia’s authorised dealer can arrange the delivery of the Prize. Winners will have seven (7) days to provide Volvo Car Malaysia’s authorised dealer with the required contact information. Otherwise, Volvo Car Malaysia’s authorised dealer reserves the right to forfeit the Prize and award it to an alternate participant.
Winners will be contacted via Instagram direct message. 6. Prize
Winners will be awarded with only one (1) prize (“Prize”) for each winner, randomised:

Prize will be shipped via standard post at no cost for the Winners at the mailing address provided within sixty (60) days or pick up the prize at the authorised dealer’s showroom.
Prize is not transferable and cannot be exchanged for cash. If any Prize is unavailable, Volvo Car Malaysia’s authorised dealer, in its discretion, reserves the right to substitute the Prize with an alternative prize to the equal value and/or specification.
7. Eligibility
Residents in Malaysia aged 18 years or over, who are not employees of Volvo Car Malaysia, its affiliated companies, the agencies connected with the Campaign or participants who are a household or an immediate family member to any of these (defined as parents, siblings, children and spouse, regardless of where they live).
Volvo Car Malaysia and authorised dealers reserves the right to verify eligibility requirements are met and may require such information as it considers reasonably necessary for this purpose.
8. Data Protection
Volvo Car Malaysia and authorised dealers will only use participants information to administer the Campaign. Volvo Car Malaysia and authorised dealers will observe and comply with the provisions of the Personal Data Protection Act 2010 and/or any regulations, rules, standards, or directions (including all the amendments made to the same from time to time) passed thereunder when it is processing the participants personal data.
9. Limitations of Liability
Except for any liability that cannot by law be excluded, Volvo Car Malaysia and authorised dealers (including its respective officers, employees, and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Campaign.
Except for any liability that cannot by law be excluded, Volvo Car Malaysia and authorised dealers (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of: (a) the content of the Posts (b) any technical difficulties or equipment malfunction (whether or not under the Volvo Car Malaysia’s control) (c) any theft, unauthorised access or third party interference (d) any Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Volvo Car Malaysia) due to any reason beyond the reasonable control of Volvo Car Malaysia (e) any variation in Prize value to that stated in these Campaign Terms (f) any tax liability incurred by a Winner or (g) use of Prize.
10. Miscellaneous
Volvo Car Malaysia and authorised dealers reserves the right to disqualify any participants from this Campaign if it has reason to believe that this Campaign Terms are not being observed.
If any provision of these Campaign Terms is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
These Campaign Terms, and all issues arising out of it shall be governed in accordance with the laws of the laws of Malaysia and are subject to the exclusive jurisdiction of the courts of the said territory.
