The following terms and conditions (the “Terms”) apply to any booking you may make to Test Drive a Volvo EX30 vehicle (the “Vehicle”) at the EX30 Pop Up Tour (the “EX30Pop Up”), (the “Test Drive”), and are between the main driver of the Test Drive Vehicle (“You, Your”) and Volvo Car UK Limited (company no.02281044) (“VCUK”). At the time of booking, You will be required to agree to the following Terms and agree to be responsible for ensuring all other drivers who have been authorised under VCUK’s insurance policy to take part in the Test Drive (“Named Drivers”) also comply with these Terms. VCUK reserves the right to withdraw the Test Drive or to amend these Terms without prior notice at any time, for whatever reason, and without liability to You for doing so.

1 ELIGIBILITY
1.1 The Test Drive is open to UK mainland residents only. You and each Named Driver:

1.1.1 must hold a current full (not provisional) EU or UK driving licence, with no more than 9 points accrued in the last 2 years, that has been valid for at least 12 months;

1.1.2 agree to submit driver licence details to allow VCUK to carry out driver licence checks on you and all Named Drivers. You may submit this at the time of booking or on the day of Your Test Drive. If you do not submit this in advance of Your Test Drive, You will be required to do so at the EX30 Pop Up which may shorten the time available for your Test Drive; and

1.1.3 are required to present all physical driving licences at the beginning of Your Test Drive. We will hold your driving licence, and that of any Named Driver safely for the duration of the Test Drive and return the same to you upon return of the Vehicle. If You fail to present all required driving licences, we will be unable to continue with the Test Drive.

1.2 All drivers must be 25 years or over to participate in the Test Drive. Drivers over the age of 75 may be required to supply information confirming their fitness to drive.

1.3 You hereby declare that:

1.3.1 You and all Named Drivers are in good health, Your and their eyesight is of the standard required for the UK road driving test and that neither You nor they are suffering from any illness or disability which may make it unsafe for You or them to drive; and

1.3.2 You and all Named Drivers have not had any motor claims where You or they are at fault in the last 3 years.

2 TERM AND BOOKING
You are only allowed to make one booking for a Test Drive. A booking comprises a 60-minute slot, including briefing, paperwork and driving time, for the Test Drive of a Vehicle (subject to availability). Bookings can be made online and in advance via the booking portal or by walk-inn appointment at the EX30 Pop Up (subject to availability).

3 TITLE
Title to the Vehicle shall remain with VCUK at all times. You and/or all Named Drivers shall not offer to sell, assign, lease, mortgage, charge, encumber or part with possession or otherwise deal with the Vehicle in any manner. We reserve the right to take all necessary legal action to recover the Vehicle should You and/or any Named Driver breach this clause 3.

4 THE VEHICLE
4.1 Vehicles for the Test Drive are subject to availability. Whilst VCUK will use all reasonable endeavours to ensure you Test Drive your chosen Vehicle model, we cannot guarantee a particular specification or engine.

4.2 The Vehicle is fitted with a dashboard camera and GPS tracking systems. You and all Named Drivers agree not to tamper with, alter or remove such systems from the Vehicle.

5 VEHICLE INSURANCE
5.1 The Driver and all Named Drivers will at all times (including during driving), operate and treat the Vehicle with reasonable care. The Vehicle is insured by VCUK strictly for Your use and use by a maximum of 2 pre-approved Named Driver(s), who have submitted their driving licence details in advance of the Test Drive period or at the EX30 Pop Up on the day of the Test Drive and been approved to drive the Vehicle by VCUK.

5.2 VCUK is self-insured, however, its motor insurance policy is third party only for Your use of the Vehicle and use by pre-approved Named Driver(s) as set out above. You must not do anything to invalidate this insurance, including driving without a licence. An excess of £500 is payable by You under the insurance policy in the event of a claim. If the value of the repair is lower than the excess charge applicable, You will only be required to contribute the actual repair cost. Excess only applies if a claim cannot be recovered from other third party insurers.

5.3 Insurance cover is solely for social, domestic and/or pleasure use. The Vehicle must not be used for business purposes or in any manner contravening clause 10 below.

5.4 VCUK must be informed immediately of any accident, theft or any damage whatsoever caused to the Vehicle by calling the EX30 Pop Up Studio on 01295 671956

5.5 VCUK shall be under no liability whatsoever in respect of loss, damage or injury to any person or persons which may occur in connection with, or arising out of, the Vehicle or its use or any defect, latent or otherwise, therein, howsoever caused and You will indemnify VCUK against all costs, claims and demands of whatever kind arising in respect of, or in conjunction with the loan of the Vehicle and its use by You and any Named Drivers.

6 CANCELLATIONS AND AMENDMENTS
If you would like to cancel or amend Your booking, please use the link provided in Your booking confirmation email or call 01295 671956. We ask You to give VCUK at least 24 hours of any amendment or cancellation.

7 VEHICLE COLLECTION
7.1 Only You are able to accept the Vehicle upon collection from the EX30 Pop Up at the booked time for your Test Drive. You will need to provide the required driving licence(s) to a staff member for safekeeping during your Test Drive. These will be returned to you when the Vehicle is returned to the EX30 Pop Up at the end of your Test Drive.

7.2 The Vehicle must be inspected by You on collection and any defects or discrepancies must be noted by You to a staff member at the EX30 Pop Up.

8 VEHICLE RETURN
8.1 The Vehicle shall be returned in a clean and roadworthy condition at the stated time.

8.2 Any loose items You remove from the Vehicle at the point of collection such as, but not limited to, parcel shelves, mats and in the case of electric vehicles, charging cables, must be placed back in the Vehicle before return.

8.3 In the event You fail to return the Vehicle, VCUK reserves the right to access data from the dashboard camera and GPS tracking systems and take all other action necessary in order to repossess the Vehicle.

8.4 VCUK reserves the right to take all necessary legal action to repossess the Vehicle and You hereby agree to indemnify VCUK against all claims or rights of action arising therefrom.

9 FINES AND CHARGES
9.1 All fixed penalty charges, parking fines, bridge tolls or congestion charges, related administration costs and similar (if applicable) incurred during the period of the Test Drive are Your sole responsibility. Any penalty charges incurred by VCUK will be recharged to You.
9.2 You are liable for any road traffic offence which is notified regarding an offence which occurred during the Test Drive period.

10 VEHICLE USE
The Vehicle has been provided for Test Drive and evaluation purposes only and should not be subject to unreasonable use. The Vehicle must only be used on public roads and may not be used for hire and reward, rallying or motorsports, or taken off-road, or for any illegal activity.

11 MOBILE PHONES OR ANY OTHER DEVICES
Any fitment of a car phone or any other device to the Vehicle is prohibited (this is different to pairing your phone to the Vehicle which is permitted).

12 SMOKING
You must refrain from smoking or vaping in any Vehicles loaned for the duration of the Test Drive. VCUK reserves the right to charge to You any cleaning fees should You fail to refrain from doing so.

13 PERSONAL POSSESSIONS
VCUK and its agents take no responsibility for any personal possessions left in a Vehicle. Personal items being transported are also not covered under the terms of any insurance.

14 GENERAL
You agree that You shall not place any signage or advertising on, or mark in any way, the Vehicle.

15 TERMINATION OF AGREEMENT
15.1 VCUK may terminate the loan of the Vehicle and the Test Drive immediately by notice to You if You and/or any Named Drivers are:

15.1.1 banned from driving or cease to hold a valid driving licence;

15.1.2 believed to be under the influence of drugs or alcohol at time of collection of the Vehicle; or

15.1.3 in breach of any of these Terms.

15.2 Upon termination under clause 15.1 and/or at the end of your Test Drive, you shall return the Vehicle to VCUK at the EX30 Pop Up . In the event that you fail to return or make the Vehicle immediately available for collection, You grant VCUK an irrevocable licence to enter the premises where the Vehicle is stored for repossession and to use all data contained in the dashboard camera and GPS tracking systems in the Vehicle in order to repossess the same.
