Specific terms for Fuel & Wash

1. Introduction

1.1

We, at Volvo (as defined in Section 1.2 below), want to offer you the Fuel & Wash Services (as defined in Section 2.1 below).

1.2

By ticking a box in a digital acceptance process, or by accepting in another reproducible manner, you acknowledge that you have read these terms for Fuel & Wash (“Specific Terms for Fuel & Wash”) and accept that a binding agreement has been entered into between you and Volvo Car USA LLC (“Volvo” or “we”, “us”, or “our”) for use of the Fuel & Wash Services.

1.3

Further, by accepting these Specific Terms for Fuel & Wash, you accept that Volvo will provide Third Parties (as defined in Section 2.2 below) with information and digital keys to your car to make sure your car is responding and to be able to find (position, flash with headlights and honk), unlock and lock your car. The purpose of this is for the Third Parties to be able to fulfill the Fuel & Wash Services to your car.

1.4

To identify your car, we will pass on the registration number, model and colour to the Third Parties.

1.5

Additional terms from Third Parties apply to define pricing, availability, applicable cancellation fees and other attributes. There are certain locations where the Fuel & Wash Services are unavailable. 2. Description of Fuel & Wash Services

2.1

Fuel & Wash Services allow you to fill up or wash your car in a location defined by you as a customer. Depending on your city, the Fuel & Wash Services’ geographical coverage and availability might vary.

2.2

Volvo has set up arrangements with select companies (“Third Parties”) to be able to offer the Fuel & Wash Services. Third Parties vary between countries and regions.

2.3

For you to use Fuel & Wash Services, you must have a Volvo ID, an active Volvo On Call subscription, and you must have agreed to these Specific Terms for Fuel & Wash.

2.4

After that, you will be able to request gas fill ups and car washes via the Volvo on Call app.

3. Service specific use requirements

3.1

Volvo does not execute the Fuel & Wash Services. Instead, the Third Parties are responsible for the actual Fuel & Wash Service, but the agreement regarding the service fulfillment is exclusively between you and Volvo. To cover your car when it is in our possession or control, we and/or our Third Parties will maintain throughout the term comprehensive liability insurance covering bodily injury and property damage including general liability, garage liability and automotive third party liability insurance. In case of unsuccessful service fulfillment, you as a customer will only need to communicate with Volvo and our Customer Care. Contact details and more information are provided in Volvo on Call.

3.2

All information related to the Fuel & Wash Services (service requirements, instructions, timings, fees, etc.) is available in the Volvo on Call app.

3.3

When registering according to 1.2 for Volvo Fuel & Wash, we will verify that your car has the necessary technical features needed to make use of the Fuel & Wash Service.

3.4

When using Fuel & Wash Services, it is your responsibility to ensure that your car is permitted to drive on public roads on the terms and conditions from other stakeholders, including but not limited to insurance companies.

3.5

If it is necessary for you to move your car in order for the Fuel & Wash Service to be performed, the Third Party will inform you.

3.6

If you need support with Volvo Fuel & Wash, you should contact Volvo through the provided support phone number or email listed in the Volvo on Call app.

4. Fees and subscription

4.1

Registration for the Volvo Fuel & Wash is free of charge but ordering the Fuel & Wash Services is associated with a cost. You agree to pay and authorize our Third Party payment processor to charge according to available payment methods in Volvo on Call for all applicable fees and taxes associated with the use of Fuel & Wash Services.

4.2

To be able to use the Fuel & Wash Services, you must hold a valid Volvo on Call subscription.

4.3

Prices may vary depending on location and time. Before completing an order, the price will be clearly visible in the Volvo on Call app. You will also receive a receipt to your registered email after the order is complete.

4.4

You must provide a complete and accurate payment method and contact information to us. We may suspend or terminate your access to the Volvo Fuel & Wash Services if fees are 30 days past due. All fees and payments are non-refundable and non-transferable except as provided in these Specific Terms for Fuel & Wash.

5. Privacy

5.1

Your and all other customers’ privacy is a matter of uttermost importance to us. We will retain your personal data up to 90 days after you are no longer registered as a Volvo on Call subscriber. Your use of Fuel & Wash Services is subject to the Volvo Car Group Customer Privacy Policy, available at https://www.volvocars.com/us/footer/privacy.

Information notice – Fuel & Wash Services in Volvo on Call

Controller

Volvo Car USA LLC, a Delaware limited liability company, with address 1 Volvo Drive, Rockleigh, New Jersey 07647 (“VCUSA”, “we”, “our” and “us”), will as controller process your personal data as described below.

Purpose and legal basis for processing

We process the personal data that you provide in connection with signing up for the Fuel & Wash Services (the “Services”) and your ordering of the Services in the Volvo on Call app. The purposes of our processing of your personal data are:

  • to administer your bookings (from purchase to fulfillment), scheduling, service provision, obtaining feedback and communicating updates related to the Services;
  • statistics, research and development; and

to be able to recognize you as a recurrent customer and thus enhance your experience as a customer. The legal basis for our processing of your personal data in order to administer your signing up for the Services and your purchase and to follow up on the delivery of the Services is that this processing is necessary for the performance of our contract with you. The legal basis for our processing of your personal data in relation to the rest of the purposes is our legitimate interest.

In addition to above, we will also process your personal data for marketing purposes. Besides processing your personal data to be able to send you our marketing communication material we will process your eventual response and interactions with the digital marketing communication that you receive and your purchase history in order to deliver relevant and high quality marketing communication and for statistical purposes. Your personal data will in this context be used for online and social profiling purposes in order to enhance our marketing communication. If you have accepted our use of cookies, we moreover combine your personal data with your online behavior on our websites when possible. The legal basis for our processing of your personal data for marketing purposes, including our processing in relation to be able to deliver relevant and high quality marketing communication as well as online and social profiling, is your consent. You have the right to withdraw your consent to our processing of your personal data related to marketing purposes at any time. Disclosure / Recipients of your personal data / Transfer

Your personal data will be disclosed to and processed by our business partners for the above purposes. Your personal data will also be disclosed to and processed by Volvo Car Corporation (a Swedish legal entity with registration number 556074-3089). In relation to our business partners located outside of EEA, we will transfer your personal data with the basis of the Standard Contractual Clauses adopted by the European Commission.

Retention time

We will retain your personal data up to 90 days after you are no longer registered as a Volvo on Call subscriber.
